Mother Waiting Arrest in International Custody Battle

Marla Smith hasn't had custody of her children in more than two years ever since her ex-husband took them to Cyprus, where he is originally from.

The conflict is that an Indiana judge ruled she should have full custody, but a Cyprus court says it has jurisdiction and gave custody to the father, CNN's Pamela Brown reports.

So, who wins out?

"It's devastating. You want to see your children every day and tell them that you love them so much," says Smith, who relocated to Cyprus to be closer to her children. "It's almost like you're mourning the loss of your children, but they're still alive."

Smith vows to keep up her fight. She says Cyprus has issued a warrant for her arrest for failing to pay child support, so she is waiting to be arrested. CNN reached out to the office of Smith's congresswoman who said they will continue to assist with requests to the Department of State.
